Reed v. Goertz

Summary:  A capital defendant convicted in state court of murder sued the state prosecutor in federal court under 42 U.S.C. s. 1983 and argued that the claim was timely because he brought it within two years of a state appellate court ruling denying him relief and rehearing relating to post-conviction DNA evidence testing.  The prosecutor argued that the defendant's Section 1983 claim was not timely because the claim accrued when the trial court - not the appellate court - denied the defendant relief.  SCOTUS held that the statute of limitations for a Section 1983 procedural due process claim begins to run when the state litigation - including appellate proceedings - ends.
